Why this page exists
West Coast US couples favor Los Cabos for flights into SJD and desert-coast venues. The legal risk is assuming Cancun's Quintana Roo checklist works in Cabo.

Legal requirements for visitors
- National rule. Only a Registro Civil marriage is legal in Mexico. Resort complimentary ceremonies on the Baja side are typically symbolic unless a civil ceremony is added. (US Embassy Mexico.)
- State difference. Los Cabos is Baja California Sur, not Quintana Roo. Medical certificates, witnesses, apostilles and translations must be confirmed with the Registro Civil in San José del Cabo or Cabo San Lucas for your date — do not reuse a Cancun checklist.
- Hard Rock-type add-ons. Some brand civil add-ons publish Mexico admin/government fees that have included blood tests in some markets; amounts vary by property and state. Get Cabo-specific pricing in writing.
- Consular note. The US Consular Agency in Cabo helps with emergencies; it does not perform marriages.
- Recognition. A valid Mexican civil marriage is generally recognized in the US; some later US uses need an apostille on the Mexican certificate.
Legal vs symbolic here
Many Cabo couples marry legally in their US county, then celebrate with a symbolic resort ceremony — skipping foreign apostilles entirely. If you want a Mexican civil marriage, treat Baja California Sur as its own project.
Paperwork checklist
- Choose Mexican civil marriage vs US marriage + Cabo symbolic celebration.
- If civil: contact Registro Civil in San José del Cabo or Cabo San Lucas (not Cancun).
- Verify whether Baja still requires in-country medical certificates for your municipality.
- Budget for apostilles, translations and witnesses per local instructions.
- Compare any resort "civil package" line items against the registry's own fees.
FAQ
Is Cabo legally the same as Cancun?
Both are Mexico, so only civil marriages are legal — but each state sets registry rules. Quintana Roo changed its medical-certificate rule in 2026; Baja California Sur may differ. Verify locally.
Can we skip Mexican paperwork?
Yes, by marrying legally at home and holding a symbolic Cabo ceremony.
Where do we fly?
Los Cabos International (SJD). Entry still requires a US passport book for air travel and an FMMd for air arrivals.
